1. Acceptance of terms
By signing up, accessing, or using ArchiManage (the “Service”), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service. These terms apply to all users, including trial users and paid subscribers.
2. Parties and definitions
“ArchiManage” means the software platform and services provided by Dominion Agency PTY LTD, and is an entity of Dominion Agency PTY LTD. “We”, “us” and “our” refer to Dominion Agency PTY LTD. “You” and “Customer” mean the individual or legal entity that registers for and uses the Service. The scope of these terms covers all access to and use of the Service, including any related websites, applications, support and updates, whether on a trial, paid or other basis.
3. Service description
ArchiManage is a workspace for creative professionals to manage projects, finances, tasks, scheduling and day-to-day work. Features, functionality and pricing may change from time to time. We will notify you of material changes that affect your paid subscription.
4. Subscription and payment
You agree to pay Dominion Agency PTY LTD for your use of the Service. Billing is based on the plan and billing period you select (for example, monthly or yearly). Prices are shown in the app before you confirm your subscription. You are responsible for keeping your payment method and billing details up to date.
All fees are non-refundable except where required by law or as expressly set out in these terms. If a payment fails, we may suspend your access until the outstanding amount is paid.
5. Cancellation
You may cancel your subscription at any time from your account or billing settings. Your service will continue until the last valid day of the billing period you have already paid for. After that date, your access will be downgraded or suspended according to the plan you selected.
6. Refunds
We do not offer refunds for subscription fees already paid, including partial-month or partial-year refunds. If you are on a free trial, no charges are made until the trial ends and you choose to upgrade. If you believe you have been billed in error, please contact us at support@archimanage.com and we will review the matter.
7. AI-generated outputs
ArchiManage may use artificial intelligence to provide suggestions, summaries, reminders, schedules, draft messages and other outputs ("AI-generated outputs"). These outputs are advisory, probabilistic, and generated by automated systems. They are not guaranteed to be accurate, complete, lawful, or suitable for your specific situation.
You should review, verify and, where appropriate, edit any AI-generated output before relying on it, especially for client communications, legal, financial, or professional advice. Dominion Agency PTY LTD is not responsible for decisions made or actions taken based on AI-generated outputs.
8. Your responsibilities
You are responsible for the data you enter, store or share through the Service, for maintaining the confidentiality of your account credentials, and for all activity under your account. You must use the Service in compliance with applicable laws and must not use ArchiManage for any unlawful, harmful, fraudulent, or illegal activities. You may not use the Service to violate any applicable law, regulation, or third-party right.
9. Prohibited use and reverse engineering
You agree not to (and will not allow a third party to) attempt, directly or indirectly, to decompile, disassemble, reverse engineer, or use any other similar process with respect to the code, logic, or information embodied by our Services. You may not copy, modify, distribute, sell, lease, or create derivative works of the Service or any part of it, except as expressly permitted by us in writing.
10. Limitation of liability
ArchiManage is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Dominion Agency PTY LTD is not responsible or liable for any direct, indirect, incidental, consequential, special, or punitive losses, damages, or expenses you may incur while using the Service, including loss of profits, data, business, reputation, or anticipated savings.
This limitation applies even if we have been advised of the possibility of such losses, and whether arising in contract, negligence, or otherwise. Nothing in these terms limits liability that cannot be excluded under applicable law.
11. Changes to these terms
We may update these Terms and Conditions from time to time. If we make material changes, we will notify you through the Service or by email before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the revised terms.
12. Governing law and disputes
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute arising from these terms or your use of the Service will be resolved in the courts of South Africa, and you consent to that jurisdiction.
